1. Acceptance of Terms
By downloading, installing, or using HyperJournal ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.
2. License to Use
HyperJournal grants you a personal, non-exclusive, non-transferable, revocable license to use the App for your personal journaling and note-taking needs.
3. User Responsibilities
You agree to:
- Use legally: Use the App in compliance with all applicable laws and regulations
- Backup your data: Regularly back up your device to prevent data loss
- Secure your device: Use appropriate security measures (passcode, biometric authentication) to protect your personal content
- Use responsibly: Not use the App for any illegal, harmful, or unethical purposes
4. Data Storage and Backup
Important: All data in HyperJournal is stored locally on your device. You are responsible for backing up your data through your device's backup system (such as iCloud or iTunes Backup).
We are not responsible for any data loss that may occur due to:
- Device failure or damage
- Accidental deletion
- Software bugs or crashes
- Operating system updates
- App uninstallation
- Any other cause
5. No Warranty
HyperJournal is provided "as is" without warranty of any kind, either express or implied, including but not limited to:
- Warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Uninterrupted or error-free operation
6. Limitation of Liability
To the maximum extent permitted by law, HyperJournal and its developers shall not be liable for any:
- Direct, indirect, incidental, or consequential damages
- Loss of data or content
- Loss of profits or business opportunities
- Damages arising from use or inability to use the App
7. Intellectual Property
HyperJournal and all associated intellectual property rights remain the property of the developers. You may not:
- Copy, modify, or create derivative works of the App
- Reverse engineer, decompile, or disassemble the App
- Remove or alter any copyright or proprietary notices
8. Updates and Modifications
We reserve the right to:
- Update, modify, or discontinue the App at any time
- Change these Terms of Service with notice
- Add or remove features
Continued use of the App after updates constitutes acceptance of any changes.
9. Termination
You may stop using the App at any time by uninstalling it from your device. We reserve the right to terminate or suspend access to the App for any reason, including violation of these Terms.
10. Third-Party Services
The App may use your device's native services (such as speech recognition). These services are governed by your device manufacturer's terms and policies. We are not responsible for third-party services or their functionality.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of California, United States, without regard to its conflict of law provisions.
12. Dispute Resolution
Any disputes arising from these Terms or use of the App shall be resolved through good faith negotiation. If negotiation fails, disputes may be resolved through binding arbitration or small claims court.
13. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
